s125: s 125 Give each new employee the Fair Work Information Statement
The employer gives every employee the Fair Work Information Statement (published by the Fair Work Ombudsman, covering the NES, awards, agreement-making, freedom of association, the FWC and FWO, termination, individual flexibility arrangements and right of entry) before, or as soon as practicable after, the employee starts employment.
Our statement of the clause of Australia Fair Work Act 2009 (Cth), held and verified: cite it as s125. The instrument verbatim is not quoted here; the held framework carries the reading.
The evidence this duty asks you to hold
Onboarding checklist recording issue of the current Fair Work Information Statement; Employee acknowledgement or email record of the statement being provided; Version control showing the current FWO version is used
What usually goes missing
Statement omitted for casuals or rehired employees; Outdated version issued; No record the statement was given
Where this lands in an audit
In Equal Pay Auditor this control informs the same-work screen, the category figures and the remediation steps, which carry their article citations on the result.
