s108-111: ss 108 to 112 Community service leave, and jury service pay for the first 10 days

An employee may be absent for an eligible community service activity (jury service, voluntary emergency management activities with a recognised emergency management body, or a prescribed activity) for the time engaged, reasonable travel and rest, and, except for jury service, where the absence is reasonable; the employee gives notice as soon as practicable and evidence on request. For non-casual employees on jury service the employer pays the base rate for ordinary hours for the first 10 days per summons, less any jury service pay received (evidence of which the employer may require). More beneficial State and Territory laws are preserved (s 112).

Our statement of the clause of Australia Fair Work Act 2009 (Cth), held and verified: cite it as s108-111. The instrument verbatim is not quoted here; the held framework carries the reading.

The evidence this duty asks you to hold

Leave records for jury and emergency service absences; Jury service make-up pay calculations for the first 10 days, net of jury pay; Policy covering volunteer emergency service members

What usually goes missing

Volunteer firefighters disciplined for emergency absences; Jury make-up pay not paid or not netted correctly; State law with more generous jury pay ignored
