r3.47-3.48: regs 3.47 and 3.48 Do not reveal family and domestic violence leave on pay slips

A pay slip does not state that an amount is for paid family and domestic violence leave, that leave taken was FDV leave, or the FDV leave balance; FDV leave pay is reported as ordinary hours or another work payment such as an allowance, bonus or overtime, unless the employee asks for it to be reported as another kind of leave. A pay slip complying with this is not false or misleading (s 536(3A)).

Our statement of the clause of Australia Fair Work Act 2009 (Cth), held and verified: cite it as r3.47-3.48. The instrument verbatim is not quoted here; the held framework carries the reading.

The evidence this duty asks you to hold

Payroll pay code configuration mapping FDV leave to an ordinary hours or neutral pay line; Test pay slips confirming FDV leave is not identifiable; Record of any employee request to report it as another kind of leave

What usually goes missing

FDV leave pay code visible on pay slips; FDV balance displayed in the employee self-service portal; Year-to-date leave summaries revealing FDV leave
